Full Contract Terms

  • The Seller guarantees that the puppy is in good health and has received:

    • Age-appropriate vaccinations

    • Age-appropriate deworming

    • A veterinary examination

    A. The Buyer agrees to have the puppy examined by a licensed veterinarian within 48 hours of receiving the puppy. If, within this 48-hour period, the veterinarian determines that the puppy is unhealthy or unfit for sale, the puppy may be returned for a full refund, provided the puppy has not been injured, neglected, or otherwise harmed while in the Buyer’s care. A written statement from the veterinarian declaring the puppy “unhealthy” for purchase is required. The Buyer also agrees that the Seller may contact the veterinarian clinic to verify the examination and the findings.

    The Seller guarantees the puppy against fatal viruses—including Distemper, Parvo, and Corona—for 48 hours from the time of purchase. This guarantee does not cover minor or non-fatal conditions such as kennel cough, dehydration, allergies, internal or external parasites/worms, or hypoglycemia. The Seller will disclose any known illnesses or health concerns prior to the sale.

  • The Seller guarantees each puppy, up until its first birthday, against any genetic diseases that can be confirmed through DNA testing.

    A. The Buyer must notify the Seller and provide a written statement from a licensed veterinarian confirming the genetic disease—along with the current diagnosis and symptoms—within 24 hours of the veterinary appointment.

    B. The Seller reserves the right to request that the Buyer obtain a second opinion from another licensed veterinarian, at the Buyer’s expense.

    C. The Buyer understands that the Seller will not reimburse any veterinary or healthcare-related expenses incurred. If a genetic disease is confirmed according to the terms above, the Seller will refund the purchase price of the puppy

  • Non-Life-Threatening Conditions
    The following conditions are not covered under this contract, as they are considered non-life-threatening or are the responsibility of the Buyer to manage:

    • Inguinal or umbilical hernias

    • Retained testicles

    • Recessed vulva

    • Cherry eye

    • X-rays

    • Grade 1 or Grade 2 luxating patellas

    • Respiratory infections

    • Low blood sugar (hypoglycemia). This condition is preventable; it is the Buyer’s responsibility to ensure the puppy is eating adequately.

    • Diagnostic testing related to Grade 1 or Grade 2 heart murmurs

    • Any infectious diseases contracted after the date of sale

    • Allergies

    • Malocclusions (crooked teeth placement). As puppies grow and develop, tooth placement can change and cannot be fully predicted. For this reason, the Seller does not cover any dental or bite abnormalities or veterinary expenses related to the puppy’s teeth.

    • Any diagnostic tests performed without prior approval from the Seller

    D. If the puppy dies from a suspected congenital or genetic defect within 12 months of its birth date, an autopsy must be performed at the Buyer’s expense by a licensed veterinarian. If the autopsy confirms a congenital or genetic defect as the cause of death, the Seller will refund the purchase price of the puppy. A written statement from the veterinarian—including the Seller’s name—must be provided. This guarantee becomes void if the findings are indeterminable or inconclusive. If an autopsy is not performed, the guarantee is no longer valid.

    E. The Buyer agrees to maintain the puppy in good health and to provide routine preventative veterinary care. This includes regular vaccinations, parasite control, and preventative medications as recommended by a licensed veterinarian. Veterinary records may be required if a refund is requested. Failure to provide routine healthcare voids this contract.

    F. If the puppy/dog is sold or transferred to a third party, this contract becomes null and void

  • A. The Buyer understands that puppies may display certain undesirable behaviors (nipping, chewing, barking, marking, etc.). The Buyer is responsible for the puppy’s ongoing, lifetime socialization and training to teach appropriate behaviors and agrees to seek help from certified professional trainers if needed. Pomeranians are typically affectionate and friendly, and Hearts of Love would never knowingly place a puppy with an unsound temperament. However, no one can guarantee a dog’s future temperament, as environmental factors, training, socialization, neglect, or abuse can influence behavior. Therefore, Hearts of Love does not warrant future temperament.

    B. The Seller does not guarantee adult size or color. Any estimate provided is based on the size and color of the puppy’s parents and is only an educated guess.

    C. The Buyer agrees to allow the Seller to share photos and videos of the puppy on social media.

    D. If the Buyer can no longer keep the puppy/dog for any reason, they agree to contact the Seller. The Buyer and Seller will work together to determine an appropriate rehoming plan. The puppy/dog must not be rehomed, transferred, or placed in a shelter or similar facility without first consulting the Seller.
    The Seller does not provide refunds to Buyers who choose not to keep the dog. Instead, the Seller will assist in rehoming, and any rehoming fee received by the Seller will be forwarded to the Buyer.
    If the Buyer finds a potential new home, the Seller must be contacted so the new home can be interviewed and approved by the Seller.

    Buyer Responsibilities

    The Buyer agrees to provide the best possible care for the puppy, including but not limited to:

    A. Raising the puppy indoors
    B. Maintaining annual veterinary care, including vaccinations
    C. Feeding high-quality puppy/dog food
    D. Seeking veterinary care when the dog is sick or injured

    The Buyer understands that all risk of loss, injury, or expense becomes their responsibility once the puppy leaves the Seller. This includes, but is not limited to:

    A. Transportation costs
    B. Medical costs
    C. Training costs
    D. Food costs

    The Seller assumes no responsibility for any expenses related to the puppy after the sale.

    Spay/Neuter & Breeding Rights

    The Buyer understands that this puppy is being sold as a pet only, without breeding rights unless seller and buyer agreed to breeding rights in writing. The puppy is not to be bred or used for breeding under any circumstances unless written permission is explicitly granted by the Seller.

    The Buyer agrees to have the puppy spayed/neutered by 12 months of age by a licensed veterinarian and must provide proof to the Seller by 13 months of age. Failure to do so results in:

    • The genetic health guarantee becoming void.

    If the puppy is bred, or used to sire a litter, without written permission from the Seller, the Buyer agrees to pay the Seller a $10,000 fine

  •  I as the Buyer of the puppy described in this Contract of Sale and Warranty, so hereby declare that I have read and fully understand and agree with the terms, conditions, and warranties contained herein. TT Seller affirms that the dog/puppy described in this Contract of Sale and Warranty is the dog delivered to Buyer. Seller agrees to the terms, conditions, and warranties contained herein.
